Sony messed with Texas and now they are getting sued

Sony BMG has had a rough month already, but it could be getting worse. Everyone is upset about the discovery of the naughtiness they were hiding on our computers. Now they’re getting sued over it. The first of what is sure to be many suits has been filed in Texas. Texas Attorney General Greg Abbott filed a civil lawsuit against Sony on Monday for hiding spyware on their CDs.

Sony has said that it has recalled all CDs with the XCP technology which has caused the furor, but Abbott said Texas investigators were able to buy severals of the CDs in Austin on Sunday.

Texas is out to extract civil penalties of $100,000 per violation of the state’s new Consumer Protection Against Computer Spyware Act.

“Sony has engaged in a technological version of cloak and dagger deceit against consumers by hiding secret files on their computers,” Abbott said.

Sony can’t send all of their lawyers to Austin to fight this suit, though. They are in trouble in Los Angeles, too. The Electronic Frontier Foundation has filed a lawsuit in Los Angeles County seeking compensation for the damage caused by the 24 million CDs sold with XCP.
